These Terms of Service ("Terms") govern your access to and use of the website smartnursingsn.com and the telehealth and healthcare services provided by Smart Nursing LLC ("Smart Nursing," "we," "us," or "our"). By accessing our website, booking an appointment, or receiving services, you agree to these Terms.
Important: If you do not agree to these Terms, do not use our website or services.
Eligibility and Account Responsibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use our services independently, or a parent/legal guardian must consent and participate for minors. You agree to provide accurate, current, and complete information when booking or registering and to keep that information updated. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
Description of Services
Smart Nursing provides telehealth primary care and related healthcare services, including but not limited to: new patient consultations, annual physicals, general and sick visits, chronic care management, medication refills, pre-employment/school physicals, weight management support, and hospital follow-up care. Services are delivered primarily via secure video consultation and may include coordination with in-person care as appropriate.
Services are provided by board-certified or appropriately licensed healthcare professionals (including Family Nurse Practitioners) practicing within the scope of their licensure and applicable state and federal law. Telehealth services are available in states where our providers are licensed or authorized to practice.
Not for Emergencies
OUR SERVICES ARE NOT FOR MEDICAL EMERGENCIES.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Telehealth is not a substitute for emergency care or in-person evaluation when clinically indicated.
Appointments, Cancellations, and No-Shows
Appointments may be scheduled through our online booking system (currently powered by OptiMantra) or by contacting us. You agree to arrive/log in on time. We reserve the right to implement reasonable cancellation and no-show policies, which may include fees for late cancellations or missed appointments. Please review any specific policy communicated at the time of booking or on our website.
Payment, Insurance, and Billing
We accept most major insurance plans, including Medicare and Medicaid where applicable, as well as self-pay. You are responsible for verifying your insurance coverage and benefits before your appointment and for any co-pays, deductibles, co-insurance, or amounts not covered by insurance. Self-pay rates apply when insurance is not used or not accepted for a particular service. Payment is due at the time of service unless otherwise arranged. We accept major credit/debit cards and HSA/FSA funds where applicable.
You authorize us to bill your insurance and to collect any patient responsibility amounts. Failure to pay may result in suspension of non-emergency services and collection efforts as permitted by law.
Patient Responsibilities
You agree to:
- Provide accurate and complete medical history and current information
- Follow treatment recommendations and instructions to the best of your ability
- Inform us of any changes in your condition, medications, or contact information
- Participate in telehealth visits from a private, appropriate location with adequate technology
- Refrain from recording telehealth sessions without prior written consent from all parties
- Treat our staff and providers with respect
Intellectual Property
All content on our website (text, graphics, logos, design, software) is owned by or licensed to Smart Nursing LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission, except for personal, non-commercial use of publicly available materials as permitted by law.
Acceptable Use of Website
You agree not to:
- Use the website for any unlawful purpose
- Attempt to gain unauthorized access to systems or data
- Interfere with or disrupt the website or servers
- Transmit malware or harmful code
- Scrape, harvest, or collect data without permission
- Impersonate any person or entity

Disclaimer of Warranties
THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT TELEHEALTH SERVICES WILL MEET ALL YOUR EXPECTATIONS OR REPLACE IN-PERSON CARE WHEN CLINICALLY NECESSARY.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMART NURSING LLC AND ITS PROVIDERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the fullest extent permitted by law. Nothing in these Terms limits liability for gross negligence, willful misconduct, or liability that cannot be limited under applicable law (including certain patient rights).

Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except that federal law (including HIPAA) governs where applicable. Any dispute arising out of or relating to these Terms or the services shall first be attempted to be resolved through good-faith negotiation.
If unresolved, disputes shall be resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction there. Nothing in this section limits any rights you may have under applicable consumer or healthcare laws.
Changes to These Terms
We may modify these Terms at any time. The updated version will be posted on our website with a new Effective Date. Your continued use of the website or services after changes constitutes acceptance. Material changes affecting existing patients may be communicated directly when required.
Termination
We may suspend or terminate your access to the website or services at any time for violation of these Terms, for clinical or safety reasons, or as otherwise permitted by law. You may discontinue use at any time. Provisions that by their nature should survive (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive termination.
